Terms of Service

1. Acceptance

By accessing or using the Abyss application ("the App") or the abyss.chat website ("the Site"), you agree to these Terms. If you do not agree, do not use the App or the Site.

2. What Abyss Is

Abyss is peer-to-peer messaging software. Messages are encrypted end-to-end on your device and relayed over the Waku P2P network. A relay node operated by the project temporarily stores encrypted message payloads to enable offline delivery, but cannot decrypt, read, or moderate the content. The operators of Abyss do not have access to the content of your messages.

3. No Account, No Personal Data

Abyss does not require an email address, phone number, or any personal information to use. Your identity is your Ethereum wallet address. Authentication is performed via Sign-In With Ethereum (SIWE), which proves you control your wallet without transmitting sensitive data.

4. User Conduct

You are solely responsible for the content you transmit through the App. You agree not to use Abyss to:

  • Transmit content that is illegal in your jurisdiction
  • Harass, threaten, or abuse other users
  • Distribute malware, phishing links, or exploit code
  • Impersonate another person or wallet
  • Attempt to interfere with the Waku network or relay infrastructure

Because Abyss is end-to-end encrypted and peer-to-peer, we cannot monitor, moderate, or remove content. Enforcement of conduct rules within a room is the responsibility of the room creator and its members.

5. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, non-infringement, or uninterrupted availability.

We do not guarantee that:

  • Messages will be delivered, stored, or retained for any period
  • The Waku P2P network will be available at all times
  • The encryption cannot be compromised by future advances
  • The App will be free of bugs or vulnerabilities

6. Limitation of Liability

To the maximum extent permitted by law, the Abyss team, contributors, and operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of funds, loss of access, or loss of privacy, arising from your use of the App.

7. Wallet Security

Your wallet private key and seed phrase are your sole responsibility. Abyss never asks for, transmits, or stores your private key. If you lose access to your wallet, you lose access to your rooms. There is no account recovery mechanism.

8. Cryptographic Keys and Room Access

Room encryption keys are stored locally on your device. Abyss does not maintain a backup of these keys. If you clear your browser data or lose your device, you may permanently lose access to room history and membership.

9. Third-Party Services

The App integrates with third-party services including the Waku P2P network, WalletConnect, and Ethereum RPC providers. These services are governed by their own terms and privacy policies. Abyss is not responsible for the availability or conduct of third-party services.

10. Token Disclaimer

References to the $ABYSS token on the Site are for informational purposes only and do not constitute financial advice, an offer to sell, or a solicitation to buy any security or financial instrument. See the Disclaimer for details.

11. Modifications

We may update these Terms at any time. Changes take effect when posted to this page. Continued use of the App after changes constitutes acceptance.

12. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which the user resides, to the extent applicable. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal remedies.
